These terms apply to purchases made through baxter.photos.
The seller is Simon Baxter Ltd trading as Simon Baxter Photography, of 22 Hunters Hill Close, Guisborough, TS14, UK. You can contact me at simon@baxter.photos.
By placing an order through this website, you agree to these terms. Nothing in these terms affects your statutory consumer rights.
Products
I take care to describe and photograph products as accurately as possible. However, colours and tonal values can vary between screens and may not exactly represent the appearance of a physical print or product.
Product dimensions, materials, editions and other important information will be stated on the relevant product page where applicable.
Prices and payment
All prices are shown in pounds sterling (£). The total amount payable, including any applicable taxes and delivery charges, will be shown before you complete your order.
Payment must be made using one of the payment methods offered at checkout.
Placing an order
When you place an order, you are offering to purchase the goods or services shown in your basket.
You will receive an email acknowledging your order. A contract is formed when I confirm acceptance of your order.
If I cannot accept an order — for example because a product is unavailable, an obvious pricing error has occurred, or I am unable to fulfil it — I will let you know and refund any payment already made.
Delivery
Delivery charges and available delivery methods are shown during checkout.
Estimated dispatch or delivery times shown on the website are estimates rather than guaranteed dates unless expressly stated otherwise. Goods will be supplied without undue delay and, unless a different timescale has been agreed with you, within the period required by applicable consumer law. UK distance-selling rules normally require delivery within 30 days unless another date has been agreed.

Cancelling an order for physical goods
For most goods purchased online, you have the right to change your mind and cancel your order within 14 days after receiving the goods.

This statutory cancellation right does not apply in the same way to goods made to your individual specifications or goods that are clearly personalised.
Faulty, damaged or incorrectly supplied goods
If an item is faulty, damaged, not as described or otherwise does not meet your statutory rights, please contact me as soon as possible at simon@baxter.photos.
Your legal rights in relation to faulty goods are separate from the right to change your mind and are not restricted by these terms. GOV.UK confirms that consumers are entitled to remedies where goods are faulty, not as described or do not do what they are supposed to do.
Photography workshops
Photography workshops are services relating to leisure activities and are normally booked for a specific date or period. Under the Consumer Contracts Regulations, this type of dated leisure service is generally excluded from the normal 14-day statutory cooling-off period.
Any deposit, balance-payment and cancellation arrangements that apply to a particular workshop will be clearly stated on the workshop page before booking and form part of your contract.
If I need to make a significant change to, postpone or cancel a workshop, I will contact you as soon as reasonably possible and explain the options available to you.
Workshop participation
You are responsible for ensuring that you are reasonably able to participate in the workshop you book, taking account of any fitness or accessibility information provided on the workshop page.
Unless expressly stated otherwise, participants are responsible for their own photographic equipment, personal belongings, travel arrangements and appropriate clothing.
Changes beyond my reasonable control
Occasionally an order or workshop may be affected by circumstances outside my reasonable control, such as severe weather, transport disruption, illness or other exceptional events.
Where this happens, I will make reasonable efforts to minimise disruption and will contact affected customers as soon as practicable.
Intellectual property
All photographs, text, videos, graphics and other original material on baxter.photos are protected by copyright and other intellectual-property rights unless stated otherwise.
Purchasing a print, book or other product does not transfer copyright in the photograph or artwork. Images may not be reproduced, copied, distributed or commercially used without prior written permission.
Liability
Nothing in these terms limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or your statutory consumer rights.
I am not responsible for losses that could not reasonably have been foreseen when the contract was made.
Privacy
Personal information provided when placing an order or making an enquiry will be handled in accordance with the website’s Privacy Policy.
Changes to these terms
These terms may occasionally be updated. The terms applying to your purchase will be those in force when your order is placed.
Governing law
These terms are governed by the law of England and Wales, subject to any mandatory consumer protections that apply to you.
